Discussions were had with the Rental Tribunal and they confirmed that there is no amendment or write up to the act to determine the number of persons per room and referred me to your office.

During a rentals course it was mentioned that 2 persons per room and if 2 rooms maximum total would be 2+2+1 =5

It seems as if managing agents/ body corporate are having their own conduct rules such as :
(a) 2 Bedrooms -> 2 grownups / 2 children ( Sectional Title)
Could also be 4 grown-ups?

(b) Environment not conducive for children as the single owner of 5 flats are letting to single elderly people, who needs peace and quiet. (share block)

It would be appreciated if you could advise.

Dear Johan

During training it was mentioned that certain municipalities have their own regulations whereby it is acceptable to have 2 persons per bedroom plus one extra. Not every municipality has such regulations.

Bodies corporate are entitled to state how many per apartment because over crowding is detrimental to any building. As a rental agent you would have to find out what is permitted with regard to children and adults.

When it comes to renting to families, you would be wise to select your tenants carefully as well as becoming aware of the general tenancy of a building. To put a young family in a building of apartments where most of the owners are elderly is just creating problems for yourself and the tenants. The house rules are important to know as your tenants have to abide by them when they become part of a sectional title scheme.
