What does the law say about fumigating |

Hello Vivien I hope you can help with a difficult situation. We don’t have anything in our lease agreement to do with cockroaches and fumigation. Our tenants have been renting a property for over a year and have now asked the owner to fumigate. They have tried pest control already with sprays and traps but it does not help. They are nesting in the circuit board areas, such as the alarm control panel DB board etc.
What does the law say about fumigating? Is it the owners responsibility or up to the tenant?

The law does not say anything about fumigation. The only principle to apply is one of fairness and as your lease does not specifically say anything about fumigation, but probably states that the tenant is responsible for internal maintenance, I would suggest that the landlord and tenant share the cost. If the tenant leaves the problem it will eventually cost the landlord a lot more if the electrical fittings are affected so it is within the landlord's interests to also contribute.
