The real estate sector will be exempted from certain provisions of the Consumer Protection Act (CPA) if industry players have their way.
Many believe the act is overly protective of tenants’ rights, to the detriment of landlords. Property owners, both residential and commercial, are particularly peeved about section 14 of the act.

On April 2011, The Consumer Protection Act 68 of 2008 ("The Act") became fuly operational and introducred a new era of substantialy improved consumer rights for those transacting in South Africa. It is unforunate that there is considerable measure of uncertainty as to the exact scope of the Act's application in various areas of business transactions. One such area is the Act's effect on leses, both commercial and residential.

Local Estate Agents in Training |

The institute of Estate Agents Garden Route, in association with Assessment Centre for Estate Agents, held a successful training session for rental agents on the 22 & 23 September in George. Thirty-five agents attended the training. Everyone left well informed and equipped to perform as professional rental agents. Ronel Heyns, IEA Chairman was encouraged by the interest shown and will be organizing another event for rental agents in the near future.

Certain players in the property industry, particularly landlords and tenants of commercial buildings will receive some welcome relief when stamp duty on leases is finally abolished.
Stamp duty on leases will be abolished with effect from April 1, 2009 through the repeal of the Stamp Duties Act, not arising from the recent budget, but through the Revenue Laws Amendment Act which was gazetted on January 8, 2009.
After welcoming the recent announcement of a 100 base points cut in the repo rate (with further proposed cuts expected soon), role players in the property industry, still operating in very tough economic conditions exacerbated by the international global financial crisis, have received little further direct tax relief following the Budget on Wednesday.
