The year is already four months old and time is not waiting for anyone! I trust you are all working well in 2012 and leasing property easily and professionally.
Consumer Protection Act: This is the most confusing act that I can remember and every attorney pronounces themselves an expert, though their interpretations are varied. The Consumer Protection Commission has not established tribunals as promised and therefore there are no cases being heard and no case history to give us guidelines to go by.
From what I am hearing a number of agencies have simplified the CPA requirements and their leases are giving all tenants the opportunity of giving 20 business days notice, with a penalty of two months rental which is generally equal to the deposit being held. A cancellation clause applies with a reasonable cancellation, and all landlords are being urged to keep their properties in a good state of repair as that is expected by the CPA.
